A plane crashed on the night of September 3 into Lake Erie, near Kelley's Island in Ohio. The plane held a 46 year-old man and his two sons. When the plane crashed, one of the boys was able to escape and was rescued by Chuck Herndon, who was on the lake in his boat that night.

According to Herndon, the 7 year-old boy matter-of-factly stated, "'My father and my brother were killed in a plane crash", once he was pulled into the boat.

The boy's father and 9-year-old brother were still missing Tuesday, a day after their single-engine plane went down around 9:30 p.m., said Chief Petty Officer Robert Lanier in Cleveland.

Local rescuers and divers searched the area where the plane the plane may have crashed, but nothing has been found. The names of the missing have not been released to the public.

For more information on this subject, please refer to our section on Airlines, Cruises, Buses, and Other Mass transit Accidents.

Originally posted at InjuryBoard by Jenny Albano

Another Drunk Driver with Multiple Convictions Causes Crash

Yet another DUI offender with multiple convictions has been involved in a crash this week in Akron. Thankfully, no one, including the drunk driver was hurt.

Danny E. Schuster, 28, of Ackley Street in Akron was arrested this morning on a sixth drunken driving charge.
Akron police found him at 3 a.m. passed out in a Honda Civic that had crashed into a guardrail on Ohio 76 at South Arlington Street, Lt. Rick Edwards said. Schuster refused to perform sobriety tests and was taken to the Summit County Jail.

Apparently, individuals like Mr. Schuster are not threatened by the rule of law or concerned with the far greater consequences of driving drunk. Worse yet, this is his 6th arrest. Mr. Schuster's other drunken driving convictions were in July last year, June 2005, April 2004, October 2002, September 2002 and October 2001.

In turn, for answers to this dilemma of how to stop this dangerous conduct, we must look to the courts to fore-go any leniency for repeat offenders who disregard the rules of the road and ignore sanctions issued by the court to keep them off our streets.
During 2005, 16,885 people in the U.S. died in alcohol-related motor vehicle crashes, representing 39% of all traffic-related deaths (NHTSA 2006).
If repeat offenders will not stop drinking and driving, then they should be treated, not like a drunk driver that simply used bad judgment, but rather like any other felon that has intentionally attempted to harm others and accordingly should be locked up for the duration.

Originally posted at InjuryBoard by Jack Landskroner

What to Do If Involved in an Car Accident

It is a good idea as a driver of a motor vehicle to be prepared in advance for the unexpected car accident. Of course basic steps can be taken to lessen the risk of getting into an accident or suffering an injury in a crash including buckling up, never driving under the influence of alcohol or drugs, not driving when overly tired and making sure the vehicle is in good working order and in particular as to wear and tear on tires and breaks. However, even the most cautious of drivers is still at risk for getting into an accident if traveling on the open roadways so it is prudent to be prepared in advance for the unexpected.

Maintaining the tools necessary to deal with an accident if one occurs is always wise. First, keeping a disposable camera in the vehicle is a good idea. This will allow the driver to document the scene if a crash occurs and there is a dispute as to who caused the accident or what damage was done. A cell phone should be in your possession if traveling long distances and used to notify the police in the event of an accident so a formal record of the incident is documented. Next, keep your insurance information with you and have the 800 claims service number for your own carrier available to report the claim. Some companies offer roadside assistance for just such an emergency. Roadside safety kits are also worth keeping in your vehicle; which can include flairs or reflective triangles to notify other traffic of the vehicles stopped in the roadway. Last, it makes good sense to have the contact number for your attorney available in the event there are questions as to your legal rights. Always speak with your lawyer before giving a statement to the insurance company for any other party involved in the accident.

Originally posted at InjuryBoard by Jack Landskroner

Explaining Damages in a Civil Law Suit: What's Your Case Worth?

Attorney Scott Smith does a nice job of summarizing the role of damages in a civil law suit in his April 7th blog post. Scott talks about compensatory, punitive and nominal damages and how they come into play when a jury makes its decision of what verdict to award a plaintiff in a personal injury law suit.

The law permits you to seek recovery after an accident to "make you whole again." The central concept is that you should be compensated in a manner that, as best as the law can arrange, places you back in the same position as you were before the accident.

The key in obtaining appropriate compensation for an injured client is to assure that the jury is provided with both comprehensive subjective evidence (e.g. the diary of the patients experiences) as well as objective evidence (xrays of broken bones or MRI findings) of the plaintiffs treatment and care. This evidence may come from the medical records, the treating doctors, the plaintiff himself or the family and friends who observed the effects of the injury upon the plaintiff.

There are no guarantees as to what a jury will elect to award in a personal injury trial however, when provided with competent testimony and quality evidence any plaintiff should feel comfortable that they will get a fair recovery.

Originally posted at InjuryBoard by Jack Landskroner

Pedestrian Killed in Accident in Barberton

Very little information has been disclosed about the death of a pedestrian in Akron this week after a vehicle struck him in the roadway on Nortan Avenue.

A 59-year-old Akron man was killed after being struck by a car when he crossed a Barberton street about 8:30 p.m. Monday. Larry W. Dean, whose last known address was on Chester Avenue in Akron, was crossing Norton Avenue near Fifth Street when he was hit. He was taken by Barberton EMS to Akron General Medical Center, where he died at approximately 9:10 p.m. According to the Summit County Medical Examiner, Dean had most recently been staying at Barberton's Shamrock Motel on Norton Avenue, not far from the scene of the accident.

The incident is under investigation by the Barberton Police Department.

Originally posted at InjuryBoard by Jack Landskroner

Another Death Caused By Drunk Driving On 71

Another life has been taken by a drunk driver. This time the reckless actions of a driver under the influence took the life of a Cleveland area man when a collision occured earlier this week..

The woman accused of killing a Brook Park man in a head-on crash on Interstate 71 Tuesday night had an alcohol level that was more than twice the legal limit, Cleveland police Lt. Thomas Stacho said today. Roger M. Harr died in a collision with Paige Bassett, 37, of Lakewood, who was driving south in the northbound lanes. Her car and Harr's pickup truck met head-on at 11:45 p.m. on the curve near MetroHealth Medical Center.

Ms. Bassett was charged with vehicular homicide.

Originally posted at InjuryBoard by Jack Landskroner

Kids Arrested For Throwing Rocks Off Overpass

As if there are not enough dangers of driving this nations highways, add to the mix the risk of kids throwing rocks off interstate overpasses, and you've created a recipe for disaster.

The Brecksville Police Department arrested two boys from Middleburg Heights on Monday night and is looking at a third juvenile suspect in connection with recent highway vandalism, including throwing rocks off overpasses onto cars on the Ohio Turnpike, Interstate 77 and Interstate 71.

In an abundance of safety, check with your insurance agent to confirm if you are covered for such an incident. Oftentimes, an insurance company would deny coverage under the uninsured or underinsured coverage portion of a policy for damage to an insured's person or property when the act of vandalism occurs. It is always better safe than to be sorry.

Originally posted at InjuryBoard by Jack Landskroner

Traumatic Brain Injury May Show No Visible Damage But Can Have Devastating Effect

When someone suffers a traumatic brain injury (TBI) in a car accident, workplace or industrial accident, or as the result of a fall, concussion or other traumatic event, the impact of the injury can be severe or appear to be almost non-existent. However, a TBI can do significant damage without leaving any visible signs, so the initial injury is often dismissed as just a bump on the head when far more damage has been done.

"There are countless 'walking wounded' who look just fine on the outside, but who aren't the same on the inside," says Jonathan Lifshitz, an assistant professor at the Spinal Cord and Brain Injury Research Center at the University of Kentucky Chandler Medical Center

TBI can result in changes to mental processing that are profound, profuse and permanent. Thinking can be slowed, attention dulled, memory muddled and judgment impaired, says Keith Cicerone, director of neuropsychology at the JFK Johnson Rehabilitation Institute in Edison, N.J.

If you or a loved one has endured a traumatic brain injury and need help Therapy can help people cope with the changes, but it doesn't always repair the damage. Long term care plans or "life care plans" become an integral part to planning and caring for a brain damaged patient. As a family member of one who has endured a TBI, there are also many pitfalls and legalities which must be endured. Take time to find quality health care providers and competent counsel who are familiar with these issues.

Originally posted at InjuryBoard by Jack Landskroner
